The price is subject to a delivery charge. All prices of goods sold in the online shop are in euro.<\/p><p>The delivery fee depends on the location of the buyer and the delivery method. The delivery charge is displayed to the buyer when placing the order.<\/p><p>Information about the goods is provided on the Online Shop directly next to the goods.<\/p><p><strong><br \/>Placing an order<\/strong><\/p><p>To order, you must add the products you want to your shopping cart. In order to place an order, you must fill in the required fields and select the appropriate delivery method. Payment takes place outside the Online Shop in a secure environment - in the case of payment by bank transfer in the secure environment of the respective bank and in the case of payment by credit card in the secure environment of Maksekeskus AS. The Seller does not have access to the customer's bank and credit card details. The contract enters into force as from the date of receipt of the amount due in the current account of the Online Shop.<\/p><p>The owner of the online shop is the controller of the personal data and forwards the personal data necessary for the execution of payments to the processor Maksekeskus AS.<\/p><p>If the ordered goods cannot be delivered due to expiry of the delivery period or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded immediately, but not later than 14 days after the notification.<\/p><p><strong><br \/>Delivery to<\/strong><\/p><p>Goods are sent to Estonia, Latvia, Lithuania.<\/p><p>To pick up the goods, the buyer has the following options: Venipak courier, parcel machines (Itella Smartpost, Omniva, DPD), the option to pick up the goods themselves.<\/p><p>The shipping costs are borne by the buyer, and the corresponding price information is displayed with the shipping method.<\/p><p>Shipments within Estonia usually arrive at the destination specified by the buyer within 10 working days from the entry into force of the sales contract. Outside Estonia, delivery will take place within 10 working days.<\/p><p>In exceptional cases, you have the right to have the goods delivered within up to 45 calendar days.<\/p><p><strong><br \/>Right of withdrawal<\/strong><\/p><p>After receipt of the order, the buyer has the right to withdraw from the e-contract within 14 days.<\/p><p>The right of withdrawal does not apply if the buyer is a legal person.<\/p><p>In order to exercise the 14-day right of withdrawal, the goods ordered may not be used in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods, in the same way as is allowed for testing the goods in a physical shop.<\/p><p>If the goods have been used for purposes other than what is necessary to ascertain the nature, characteristics and functioning of the goods, or if the goods show signs of use or wear, the Online Shop has the right to reduce the refundable fee in accordance with the reduction in the value of the goods.<\/p><p>In order to return goods, you must submit a withdrawal form, which can be found here: <a href=\"https:\/\/westonclimate.com\/en\/5564-2\/\" target=\"_blank\" rel=\"noopener\"><em>Withdrawal notice<\/em>\u00a0<\/a>and send it to sales@westonclimate.com within 14 days of receipt of the goods.<\/p><p>The cost of returning the goods is borne by the buyer, unless the reason for the return is that the product to be returned does not correspond to what was ordered (e.g. wrong or defective product).<\/p><p>The buyer must return the goods within 14 days of the date of the application or provide proof that he has handed them over to the carrier within that period.<\/p><p>Upon receipt of the returned goods, the online shop will return to the buyer immediately, but not later than 14 days after receipt of the withdrawal, all payments received from the buyer under the contract.<\/p><p>The online shop may refuse to make a refund until it has received the goods covered by the contract or until the buyer has provided proof that he has returned the goods, whichever is the earlier.<\/p><p>If the buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Shop, the Online Shop is not obliged to reimburse the consumer for the cost that exceeds the cost of the usual delivery method.<\/p><p>The online shop has the right to withdraw from the sale and to demand the return of the goods from the buyer if the price of the goods in the online shop is marked significantly below the market price of the goods due to a mistake.<\/p><p><strong><br \/>Right to lodge a complaint<\/strong><\/p><p>The online shop is liable for the non-conformity or defect of the goods sold to the buyer, which already existed at the moment of delivery and which will become apparent within a maximum of two years from the delivery of the goods to the buyer.\u00a0<b data-stringify-type=\"bold\">Thereafter, for a period of 1 year from the delivery of the goods to the purchaser, the defect is presumed to have existed at the time of delivery. It is the responsibility of the Online Shop to rebut this presumption.<\/b><\/p><p>In the event of a defect, the purchaser has the right to contact the online shop within two months at the latest by sending an e-mail to sales@westonclimate.com or by calling +372 5568 9584.<\/p><p>The online shop is not liable for defects that occur after the goods have been delivered to the buyer.<\/p><p>If the goods purchased from the Online Shop have defects for which the Online Shop is responsible, the Online Shop will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Online shop will refund the buyer all the fees for the sales contract.<\/p><p>The online shop will respond to the consumer's complaint in writing or in a format that can be reproduced in writing within 15 days.<\/p><p><strong><br \/>Direct marketing and processing of personal data<\/strong><\/p><p>The online shop uses the personal data provided by the buyer only to process the order and send the goods to the buyer. The online shop forwards personal data to companies providing transport services in order to deliver the goods.<\/p><p>The online shop sends newsletters and offers to the buyer's e-mail address only if the buyer has expressed his\/her wish to receive them by entering his\/her e-mail address on the website and has indicated his\/her wish to receive direct mail notifications.<\/p><p>The purchaser may opt-out of receiving offers and newsletters by email at any time by notifying us by email or by following the instructions in the email containing the offers.<\/p><p><strong><br \/>Dispute resolution<\/strong><\/p><p>If the buyer has any complaints regarding the Online Shop, they should be sent by e-mail to sales@westonclimate.com or by phone +372 5568 9584.<\/p><p>If the buyer and the Online Shop are unable to resolve the dispute through an agreement, the buyer can turn to the Consumer Disputes Committee. You can read the terms and conditions of the procedure and submit an application to <a href=\"https:\/\/komisjon.ee\/et\/avalduse-esitamine\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>. The Consumer Disputes Committee is competent to settle disputes arising from a contract concluded between the buyer and the Online Shop. Tasumine toimub v\u00e4ljaspool Veebipoodi turvalises keskkonnas \u2013 pangalingiga tasumisel vastava panga turvalises keskkonnas ja krediitkaardiga tasumisel Maksekeskus AS turvalises keskkonnas. M\u00fc\u00fcjal puudub ligip\u00e4\u00e4s kliendi panga ja krediitkaardi andmetele. Leping j\u00f5ustub alates tasumisele kuuluva summa laekumisest Veebipoe arvelduskontole. Veebipoe omanik on isikuandmete vastutav t\u00f6\u00f6tleja ning edastab maksete teostamiseks vajalikud isikuandmed volitatud t\u00f6\u00f6tleja Maksekeskus AS-le. Kui tellitud kaupa ei ole v\u00f5imalik tarnida seoses kauba l\u00f5ppemisega v\u00f5i muul p\u00f5hjusel, teavitatakse sellest ostjat esimesel v\u00f5imalusel ning tagastatakse tasutud raha (sh kauba k\u00e4ttetoimetamise kulud) viivitamata, kuid mitte hiljem kui 14 p\u00e4eva jooksul teate saatmisest. Kohaletoimetamine Kaupu saadetakse j\u00e4rgmistesse riikidesse: Eesti, L\u00e4ti, Leedu. Kauba k\u00e4ttesaamiseks on ostjal j\u00e4rgnevad valikud: Venipak kuller, pakiautomaadid (Itella Smartpost, Omniva, DPD), ise kaubale j\u00e4rele tulemuse v\u00f5imalus. Kauba saatmiskulud kannab ostja ning vastav hinnainfo on kuvatud saatmisviisi juures. Eestisisesed saadetised j\u00f5uavad \u00fcldjuhul ostja m\u00e4\u00e4ratud sihtpunkti 10 t\u00f6\u00f6p\u00e4eva jooksul alates m\u00fc\u00fcgilepingu j\u00f5ustumisest. V\u00e4ljaspool Eestit toimub kohaletoimetamine 10 t\u00f6\u00f6p\u00e4eva jooksul. Erandlikel juhtumitel on \u00f5igus kaup kohale toimetada kuni 45 kalendrip\u00e4eva jooksul. Taganemis\u00f5igus P\u00e4rast tellimuse k\u00e4ttesaamist on ostjal \u00f5igus e-poes s\u00f5lmitud lepingust taganeda 14 p\u00e4eva jooksul. Taganemis\u00f5igus ei kohaldu, kui ostjaks on juriidiline isik. 14-p\u00e4evase tagastamis\u00f5iguse kasutamiseks ei tohi tellitud kaupa kasutada muul viisil kui on vajalik kauba olemuses, omadustes ja toimimises veendumiseks viisil nagu see on lubatud kauba testimiseks f\u00fc\u00fcsilises poes. Kui kaupa on kasutatud muuks otstarbeks kui on vajalik kauba olemuses, omadustes ja toimimises veendumiseks v\u00f5i sellel on kasutamise v\u00f5i kulumise m\u00e4rke, on Veebipoel \u00f5igus alandada tagastatavat tasu vastavalt kauba v\u00e4\u00e4rtuse v\u00e4henemisele. Kauba tagastamiseks tuleb esitada kauba ostmisest taganemise avaldus, mille vormi leiab siit: taganemisavaldus\u00a0ning saata see e-posti aadressile sales@westonclimate.com hiljemalt 14 p\u00e4eva jooksul kauba k\u00e4ttesaamisest. Kauba tagastamise kulud kannab ostja, v\u00e4lja arvatud juhul, kui tagastamise p\u00f5hjus seisneb asjaolus, et tagastamisele kuuluv toode ei vasta tellitule (nt vale v\u00f5i defektiga toode). Ostja peab kauba tagastama avalduse esitamisele j\u00e4rgneva 14 p\u00e4eva jooksul v\u00f5i esitama t\u00f5endi, et ta on eelnimetatud perioodi jooksul kauba \u00fcle andnud kauba vedajale. Veebipood tagastab tagastatava kauba k\u00e4ttesaamisel ostjale viivitamata, kuid mitte hiljem kui 14 p\u00e4eva m\u00f6\u00f6dumisel arvates taganemisavalduse saamisest, k\u00f5ik ostjalt lepingu alusel saadud tasud. Veebipood v\u00f5ib keelduda tagasimaksete tegemisest seni, kuni on lepingu esemeks oleva asja tagasi saanud v\u00f5i kuni ostja on esitanud t\u00f5endid, et on asja tagasi saatnud, s\u00f5ltuvalt sellest, kumb toimub varem. Kui ostja on s\u00f5naselgelt valinud Veebipoe pakutud k\u00f5ige odavamast tavap\u00e4rasest asja k\u00e4ttetoimetamise viisist erineva k\u00e4ttetoimetamise viisi, ei pea Veebipood tarbijale tagastama kulu, mis \u00fcletab tavap\u00e4rase k\u00e4ttetoimetamise viisiga seotud kulu. Veebipoel on \u00f5igus taganeda m\u00fc\u00fcgitehingust ning n\u00f5uda ostjalt tagasi kaup, kui kauba hind veebipoes on eksituse t\u00f5ttu m\u00e4rgitud oluliselt alla kauba turuhinna. Pretensiooni esitamise \u00f5igus Veebipood vastutab ostjale m\u00fc\u00fcdud kauba lepingutingimustele mittevastavuse v\u00f5i puuduse eest, mis oli olemas juba asja \u00fcleandmise hetkel ning mis ilmneb kuni kahe aasta jooksul, alates kauba \u00fcleandmisest ostjale.\u00a0Sellest 1 aasta jooksul alates asja \u00fcleandmisest ostjale eeldatakse, et puudus oli olemas juba asja \u00fcleandmise ajal. Vastava eelduse \u00fcmberl\u00fckkamine on Veebipoe kohustus. Ostjal on \u00f5igus puuduse ilmnemisel p\u00f6\u00f6rduda hiljemalt kahe kuu jooksul veebipoe poole, saates e-kirja aadressile sales@westonclimate.com v\u00f5i helistada telefonil: +372 5568 9584. Veebipood ei vastuta puuduste eest, mis on tekkinud p\u00e4rast kauba \u00fcleandmist ostjale. Kui Veebipoest ostetud kaubal on puudused, mille eest Veebipood vastutab, parandab v\u00f5i asendab Veebipood puudusega kauba. Kui kaupa ei ole v\u00f5imalik parandada ega asendada, tagastab Veebipood ostjale k\u00f5ik m\u00fc\u00fcgilepinguga kaasnenud tasud. Veebipood vastab tarbija esitatud kaebusele kirjalikult v\u00f5i kirjalikku taasesitamist v\u00f5imaldavas vormis 15 p\u00e4eva jooksul. Otseturustus ja isikuandmete t\u00f6\u00f6tlemine Veebipood kasutab ostja poolt sisestatud isikuandmeid ainult tellimuse t\u00f6\u00f6tlemiseks ning kauba ostjale saatmiseks. Veebipood edastab isikuandmeid veoteenust pakkuvale ettev\u00f5tetele selleks, et kohale toimetada kaupa. Veebipood saadab ostjale uudiskirju ning pakkumisi ostja e-maili aadressile ainult juhul, kui ostja on selleks avaldanud soovi sisestades veebilehel e-kirja aadressi ning andnud teada oma soovist otsepostituse teadete saamiseks. Ostjal on igal ajal v\u00f5imalik loobuda e-postile saadetavatest pakkumistest ja uudiskirjadest andes sellest meile teada e-kirja teel v\u00f5i j\u00e4rgides pakkumisi sisaldava e-kirjas toodud juhiseid. Vaidluste lahendamine Kui ostjal on Veebipoe osas pretensioone, tuleb need saata e-kirja aadressile sales@westonclimate.com v\u00f5i helistada telefonil: +372 5568 9584. Kui ostja ja Veebipood ei suuda lahendada vaidlust kokkuleppe teel, siis on ostjal v\u00f5imalik p\u00f6\u00f6rduda Tarbijavaidluste komisjoni poole. Menetlustingimustega saab tutvuda ning avaldust esitada siin. Tarbijavaidluste komisjoni p\u00e4devuses on lahendada ostja ja Veebipoe vahel s\u00f5lmitud lepingust tulenevaid vaidlusi. Ostja kaebuse l\u00e4bivaatamine komisjonis on tasuta.
